Terms of use

1. Agreement

By using the Service you agree to these terms and to the privacy policy. If you do not agree, do not use the Service. You must be at least 18 years old, or the age of majority where you live, to join the alerts waitlist.

2. What the Service is

Pullnomics is an information service. It publishes third-party market prices for Pokémon, One Piece and Riftbound trading cards and sealed products (TCGplayer market values via TCGCSV), price histories, expected-value estimates for sealed products, links to eBay search results filtered against those prices, and related editorial content. Where the site compares an individual eBay offer with a market price, it publishes that comparison as a “Deal Score”. Pullnomics does not sell, buy, hold, ship, grade or authenticate any card or product. Every transaction takes place on the site a link opens (eBay, TCGplayer or a store), between you and the seller, under that site’s terms, and Pullnomics is not a party to it.

3. No guarantee of prices, scores or availability

• Listing prices, shipping costs and availability are captured at a point in time and can change or disappear at any moment. The price on eBay at checkout is the only price that counts.
• Market prices are TCGplayer market values republished by TCGCSV and refreshed daily. They are one measure of value, not a promise that a card can be sold for that amount.
• Deal Scores, confidence levels, sealed expected values and pull-rate figures are automated estimates built from the data above and from published pull-rate studies. They are opinions expressed as numbers. They are not appraisals, investment advice or guarantees of value, and they can be wrong when a listing is matched to the wrong card, when a title is ambiguous, or when the underlying data is stale.
• Graded cards are not scored and do not appear in the deal feed. Auction prices can rise before the auction ends.
• You are responsible for checking the listing, the seller, the photos and the condition on eBay before you bid or buy. If something looks too good to be true, it is usually a mismatch; use the “report a problem” link on the card page.

4. Affiliate disclosure and advertising

Pullnomics participates in the eBay Partner Network. Links to eBay are affiliate links: if you click one and complete a qualifying purchase, eBay pays Pullnomics a commission. This does not change the price you pay. By default, listings are ranked by Deal Score, which is computed from three things: the landed price against TCGplayer market; a confidence rating that reflects the match, how clearly the condition is stated and the seller feedback; and the listing format. Auctions are weighted at 70%, partly because the bid can still rise and partly because eBay pays a commission on an auction only when the bid is placed within 24 hours of the click and the auction is won within 10 days. The Service may also display advertising served by third parties. Pullnomics does not accept payment for placement of any listing, seller or product.

5. No affiliation

Pullnomics is an independent fan-run project. It is not owned, endorsed or sponsored by The Pokémon Company, Nintendo, Creatures Inc., GAME FREAK inc., Bandai, Shueisha, Toei Animation, Riot Games, UVS Games, eBay Inc., TCGplayer or TCGCSV. Its only paid relationship with eBay is the eBay Partner Network membership described in section 4. Pokémon and all card names, characters and artwork are trademarks and copyrights of their respective owners. ONE PIECE is ©Eiichiro Oda/Shueisha, Toei Animation, and the One Piece Card Game is published by Bandai. eBay is a trademark of eBay Inc. TCGplayer is a trademark of TCGplayer, Inc. Listing titles, photographs and descriptions belong to the sellers who wrote them and to eBay; where the site shows any, it does so only to link to the listing on eBay.

6. Acceptable use

You may browse the Service, subscribe to the RSS feed, and link to any page. You may not:

• access the Service by automated means at a rate or scale that a person could not, or in a way that degrades it for others (the RSS feed is the supported machine interface);
• copy, republish or resell the site’s deal scores, price data or expected-value figures as a dataset or competing service;
• interfere with the click-tracking beacon, forge clicks, or use the Service to generate affiliate commissions fraudulently;
• subscribe an email address you do not control to alerts, or use the alert tokens of another person;
• remove or obscure any notice, or misrepresent the Service as your own or as endorsed by any rights holder.

7. Alerts

Alert emails are not sending, and there is no date for them. The alerts page saves a waitlist entry, which is your email address and what you asked to watch; nothing is emailed. To delete your entries, email us from that address. The rest of this section applies if alert emails start.

Alerts are free. Delivery requires you to confirm your email address; unconfirmed alerts are never sent. We may limit the number of alerts per address, the number of instant emails per day, and may pause or discontinue alerts at any time, including if messages to your address bounce. Every alert email includes an unsubscribe link and a one-click unsubscribe header, and opt-outs take effect immediately. Alert emails are informational and are subject to section 3.

8. Intellectual property

The text, design, code, Deal Score methodology and expected-value model of the Service are owned by the operator of Pullnomics and may not be reproduced beyond fair use without permission. Card names, images and artwork, and third-party data, remain the property of their owners. We show them to identify the cards and products whose prices we describe, and we name the main sources of our data on the methodology page. We do not claim any licence or endorsement from their owners. If you hold rights in anything shown here and want it removed or credited differently, contact hello@pullnomics.com with the URL and details and we will respond promptly.

9. Third-party sites

The Service links to eBay and other external sites. We do not control those sites and are not responsible for their content, policies or transactions. Your use of eBay is governed by eBay’s terms and, where applicable, its buyer-protection programme.

10. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted operation. We do not warrant that any deal is genuine, any price current, any match correct, or any card authentic.

11. Limitation of liability

To the fullest extent permitted by law, the operator of Pullnomics will not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of money, profits, data or goodwill, arising from your use of or reliance on the Service, including purchases made on eBay after following a link from the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us to use it (nothing) and one hundred US dollars. Some jurisdictions do not allow certain limitations, in which case they apply to the extent permitted.

12. Indemnity

You agree to indemnify the operator of Pullnomics against claims and costs arising from your breach of these terms or your misuse of the Service.

13. Changes and termination

We may change the Service or these terms at any time; the effective date above tells you which version applies. Continued use after a change means you accept it. We may block access or delete alert subscriptions that violate these terms without notice.

14. Governing law

These terms are governed by the laws of the United States of America and the state in which the operator resides, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally by email shall be brought exclusively in the state or federal courts located in that state, and you consent to their jurisdiction. Nothing in this section removes protections you have as a consumer under the mandatory laws of your own country.
