Terms of use

1. Agreement

By using the Service you agree to these terms and to the privacy policy. If you do not agree, do not use the Service. You must be at least 18 years old, or the age of majority where you live, to subscribe to alerts.

2. What the Service is

Pullnomics is an information service. It collects publicly listed Pokémon trading card and sealed-product offers from eBay through eBay’s official API, compares each offer’s price with a third-party market price, and publishes the comparison as a “Deal Score”, expected-value estimates for sealed products, price histories and related editorial content. Pullnomics does not sell, buy, hold, ship, grade or authenticate any card or product. Every transaction takes place on eBay, between you and the seller, under eBay’s user agreement, and Pullnomics is not a party to it.

3. No guarantee of prices, scores or availability

• Listing prices, shipping costs and availability are captured at a point in time and can change or disappear at any moment. The price on eBay at checkout is the only price that counts.
• Market prices are TCGplayer market values republished by TCGCSV and refreshed daily. They are one measure of value, not a promise that a card can be sold for that amount.
• Deal Scores, confidence levels, condition adjustments, sealed expected values and pull-rate figures are automated estimates built from the data above and from published pull-rate studies. They are opinions expressed as numbers. They are not appraisals, investment advice or guarantees of value, and they can be wrong when a listing is matched to the wrong card, when a title is ambiguous, or when the underlying data is stale.
• Graded cards are displayed but not scored. Auction prices can rise before the auction ends.
• You are responsible for checking the listing, the seller, the photos and the condition on eBay before you bid or buy. If something looks too good to be true, it is usually a mismatch; use the report link on the card page.

4. Affiliate disclosure and advertising

Pullnomics participates in the eBay Partner Network. Links to eBay are affiliate links: if you click one and complete a qualifying purchase, eBay pays Pullnomics a commission. This does not change the price you pay and does not affect how listings are ranked; ranking is determined solely by Deal Score, which is computed from prices. The Service may also display advertising served by third parties. Pullnomics does not accept payment for placement of any listing, seller or product.

5. No affiliation

Pullnomics is an independent fan-run project. It is not affiliated with, endorsed by or sponsored by The Pokémon Company, Nintendo, Creatures Inc., GAME FREAK inc., eBay Inc., TCGplayer or TCGCSV. Pokémon and all card names, characters and artwork are trademarks and copyrights of their respective owners. eBay is a trademark of eBay Inc. TCGplayer is a trademark of TCGplayer, Inc. Listing titles, photographs and descriptions belong to the sellers who wrote them and to eBay, and are shown under eBay’s developer program terms for the purpose of linking to the listing.

6. Acceptable use

You may browse the Service, subscribe to the RSS feed and alerts, and link to any page. You may not:

• access the Service by automated means at a rate or scale that a person could not, or in a way that degrades it for others (the RSS feed is the supported machine interface);
• copy, republish or resell the deal feed, price data or expected-value figures as a dataset or competing service;
• interfere with the click-tracking beacon, forge clicks, or use the Service to generate affiliate commissions fraudulently;
• subscribe an email address you do not control to alerts, or use the alert tokens of another person;
• remove or obscure any notice, or misrepresent the Service as your own or as endorsed by any rights holder.

7. Alerts

Alerts are free. Delivery requires you to confirm your email address; unconfirmed alerts are never sent. We may limit the number of alerts per address, the number of instant emails per day, and may pause or discontinue alerts at any time, including if messages to your address bounce. Every message includes an unsubscribe link and one-click unsubscribe header, and opt-outs take effect immediately. Alert emails are informational and are subject to section 3.

8. Intellectual property

The text, design, code, Deal Score methodology and expected-value model of the Service are owned by the operator of Pullnomics and may not be reproduced beyond fair use without permission. Third-party data, marks and images remain the property of their owners and are used under their respective terms. If you believe content on the Service infringes your rights, contact hello@pullnomics.com with the URL and details of the claim and we will respond promptly.

9. Third-party sites

The Service links to eBay and other external sites. We do not control those sites and are not responsible for their content, policies or transactions. Your use of eBay is governed by eBay’s terms and, where applicable, its buyer-protection programme.

10. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted operation. We do not warrant that any deal is genuine, any price current, any match correct, or any card authentic.

11. Limitation of liability

To the fullest extent permitted by law, the operator of Pullnomics will not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of money, profits, data or goodwill, arising from your use of or reliance on the Service, including purchases made on eBay after following a link from the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us to use it (nothing) and one hundred US dollars. Some jurisdictions do not allow certain limitations, in which case they apply to the extent permitted.

12. Indemnity

You agree to indemnify the operator of Pullnomics against claims and costs arising from your breach of these terms or your misuse of the Service.

13. Changes and termination

We may change the Service or these terms at any time; the effective date above tells you which version applies. Continued use after a change means you accept it. We may block access or delete alert subscriptions that violate these terms without notice.

14. Governing law

These terms are governed by the laws of the United States of America and the state in which the operator resides, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally by email shall be brought exclusively in the state or federal courts located in that state, and you consent to their jurisdiction. Nothing in this section removes protections you have as a consumer under the mandatory laws of your own country.
